I am wanting a divorice, I haven't been with my wife for 4 years and now she is in prison. Can she contest, and also do I have to get a lawyer.
If she will agree to sign, you don't need an attorney, can she contest, of course she can.
Anyone can contest a divorce, however her current situation won't really help her, they may only hurt her. From my understanding, some states don't even let those in prison contest a divorce. You'll need to research your states laws regarding divorce to be sure.
If she contests the divorce you'll need a lawyer and it can be quite a fight. If she agrees, then its relatively simple and it does not require a lawyers assistance.
You would need to file, serve her the papers, wait for her response, then go from there.
