    How do I get custody back of my child
    2 years ago I had got my child take away on a false report of child neglect and he was placed with his fathers mother. I was assigned to a case plan and did not complete it and lost my custody of my son and his father was awarded custody. Well now I am able to provide for my son and have been clean from drugs for a year now and would like to find out what steps I need to make to get my son back. I have been living with my son and his fathe are for a year now and I feel I am having to stay in a relationship with my sons father just so I can be with my son and I sont like that. I would like to have my rights back so that I don't have to be in a relationship with the father I'm just not happy with thim and the only reason I am with him is for my son. Please help me!!

    Well for starters you will have to move out to prove that you really are taking care of yourself. Then get a lawyer and go to court. The judge if he/she even entertains the idea will probably make you go to some parenting classes and have weekly or monthly checks on you. But I really don't see you getting custody back after that you may get some visitation though. It will take a long time before you will be able to keep your son with you all the time most likely many years.

    But I don't want to move out and be away from my son, I got this house and he and his father moved in. his father is very vendivtive and will keep me away from him if I leave him. My boy needs me and I need to be with him.

    If you own the house (or are the one on the rental lease) then you will have the choice of either letting the father and the boy stay or evicting the father and then file for custody. You could try to file for custody now based on the fact that they live in your house but I would still recommend a lawyer because once custody is taken from you (especially by child services) it is very hard to get it back.

    This has to be done through the court. You have to file for a change in custody. I also agree that you should get an attorney to protect your interests.
