    Ex-boyfriend requesting his name off the car lease.
    So last yr I moved out of mine and my ex-boyfriend's apt. He agreed to pay rent for the apt and I agreed to pay for the car lease that has both of our names on it. The agreement was not in writing but my Aunt was the financial mediator between the two of us; because I actually have a restraining order on him. He's talked to my aunt about me getting the car lease in just my name only. Back then I actually did try and got info, it turns out that the cost of getting out of the car lease is way over my budget. After he was told that I was unable to get his name off the car lease he went to my work to try and take it so he could turn it in, he ended up getting arrested for violating the restraining order. Now he is sending me to small claims court for my half of the apt rent and also to get his name off the car lease. I already have legal documents saying that my name was taken off the apt lease early, but I am worried about the car situation. He signed a legal agreement that he would be my co-signer until the car lease is up. I still have 2yrs left on the car lease and the least expensive way to get rid of the car is to wait out the car lease for the remaining two yrs. He is not willing to pay anything and just wants me to deal with all of the penalties. Would the judge be in favor of him at all? How can I win my case?

    The only way you can take his name off the lease is by signing a new contract in your name only. As you said, that's out of your budget. I'm not sure what you mean when you say he "wants you to deal with all of the penalties" because if I'm understanding it right, you're the only one with access to the vehicle; why do you expect him to pay for it? By co-signing, he guaranteed that he would pay the lease if you defaulted on it. If you do that, though, they're just going to repo the car and it's going to show up on both your and his credit reports.

    If you have legal documentation that your name was taken off the lease, then your boyfriend can't sue you for rent for those months because you weren't living at those premises.

    Sorry small claims court does not have the authority to order it off,
    It just can not happen, unless you get it transferred into your name. But normally car company will not agree.

    The court may order you to pay for it, or you may sue to get the court to order him to pay for it, But it will not come off and if someone does not pay, it will effect both of your credit.

    Obviously he has not talked to an attorney
