I am a new mother. My daughter is 7 weeks old. There was a question from the beginning of the pregnancy for the child's paternity between two men; one being a bad mistake and the other being the man I'd been dating for the last 5 years. When the time came time to be born the man I was dating wanted to take on the responsibility of my daughter and gave her his last name on the birth certificate. Now after these few short weeks he is convinced she looks like the other person and wants nothing to do with neither she nor I. How do I change her name back to my last name? I'm desperate to change it because he says he is NEVER going to love her because she isn't his.

Have you done a DNA test? You need to do that before you try to change her last name. Did he sign the birth certificate?

"looks like" sorry you can't ever go by that, you need a DNA test to find out, if the test proves he is not the father, it will be easier to remove him from the birth certificate

He did sign the birth certificate. He said he would take the DNA test but in all actuality I believe he is not the father. He doesn't obviously want to be the father any way because at first even though the paternity was unsure he was willing to step in and be "daddy". But after the fact she was born and he realized he had to get and maintain a job not only to help support her but mainly to support himself he backed out. He's never really been a provider and doesn't work. Why I even wanted him to be the father in the first place is beyond me. So do I need to contact the Department of Human Services or child support offices to get a DNA test?

You would need to contact the Department of Human Resources and ask them what you need to do. I am not positive of the process because I have never done the DNA test thing. Good luck with everything!

First, get a paternity test.

If it turns out that the baby is not his, submit the info to your local vital statistics department and they should be able to change the birth certificate.
