    Hi experts

    My question is:
    I am an indian citizen. I was on opt fron 1 jan08 and from 1 oct 08 on h1b. From jan 08 I am in Colorado.
    I will be opening an nre account:
    1) if balance is more than 10000$, then do I have to fill form TD F 90-22.1 ? Do I have to fill it or only usa citizens?
    a) do I have to pay taxes on its interest?
    2) do I come under resident or non-resident alien category?
    3) what all tax forms will I have to fill

    On F1/OPT you are exempt from residency. On H1-B you do not meet substantial presence test.
    If for 2008, you file non-resident tax return, then you do not file TD F 90-22.1.

    On the resident return, you will report your worldwide income.
