    Parental death without will
    Father died , no will. My mother is alive and myself (daughter) only surviving family. How to handle estate without a will.dealing with about $100,000.00 in inheritance. My mother in nursing home not mentally capable of handling finances.

    The rules are different in each state. Generically speaking, you should go to the clerk's office of your local courthouse and ask for the "paperwork to be appointed administrator" of an estate. Fill out the forms. If you get stuck, try a half-hour with an attorney though your county lawyer-referral service.

    If your mother is being funded by Medicaid for the nursing home, it will get complicated. But that is probably not the situation. If it is, it may be good to consult an elder care attorney.

    As said each state is different. Does your mother have a power of attorney for anything or was that your father? If that was your father then you will need to apply for the position (shouldn't be hard). You may want to go see a lawyer though if you can't get it done quickly. But like I said each state is different with their laws.
