    CA 540 NR (part year resident california)
    My spouse worked for only 60 days in 2007 in California. She has no income apart from the CA income in 2007. I worked and lived in Maryland all year and she lived with me all year except for those 60 days she worked in California. We filed our federal and Maryland taxes jointly... but would like to file the CA as married filing separately.

    What is the best option for filing?

    CA 540 NR - Married filing Jointly is ripping us off
    - Single (CA filing is different from Federal filing) is not correct either

    CA 540 NR does not have an option on married but filing separate... how do we file now...

    If you file your federal return jointly, you MUST file the California return jointly.

    However, you only report the income earned while in California.

    She also files as a part-year resident.

    If you do that. More than likely she will pay little, if any, California state tax.

    Your joint CA income is the income your spouse earned during 60 days in CA.
