If it was a joint account all of the money belongs (belonged) to you and all of it to the other person so either one of you could take out all the money and do whatever with it.

I don't understand what the argument is -

I know very little about the law in England so if there is more to this and you could be criminally charged someone else will have to come along and answer that.
