    Florida Statue of Limitations - car accident
    On 9/15/2008 a lawsuit was filed against me in Duval County, Florida for a car accident that occurred on 9/17/2004.

    I do not know the duration of the Statue of Limitations in Florida for this kind of litigation.

    Both the Plantiffs and the Defendant (me) are residents of St. Johns County, Florida, and the accident occurred in St. Johns County, Florida.

    Shouldn't this lawsuit have been filed in St. Johns County, FL?

    If yes, then has the Statue of Limitations expired, barring further actions?

    The Florida Statute is 4 years - the papers have to be filed with the Court within that time frame. It appears it is within the Statute - by 2 days.

    I am not familiar with Counties in Florida but if one Court is overloaded in other parts of the US a lawsuit is allowed to be filed in another County.

    Or has the Plaintiff moved?

    Who is defending this? Your insurance company? If so they have Attorneys who do nothing BUT defend and they will have all the answers.
