I was involved in a car accident in feb of 2008. The driver was drunk and taken to jail. He has car insurance but I don't. Can I get money for damages from him personally?

You can get money from his insurance company, you not having insurance does not matter on your right to collect. It just means you don't have your company to fight for you.

So you file a claim with his insurnce company.

Get insurance. There is no excuse. You should not be driving without it legally anyway.

You can file a claim against the other driver's insurance company, but expect to get your claim rejected. If it is for an injury or extensive damage to your auto, I would suggest getting an attorney involved versus trying to file a claim on your own. Be sure to get a copy of the police report on this incident also.
