Texas law - There is no specific Statute which sets forth conditions for Grandparent visitation/custody. Taken into effect: determination that one of the parents is deceased, incompetent, incarcerated, has had rights suspended or severed. Visitation MAY be awarded if parents are divorced, child has been abused or neglected, child adjudicated delinquent or in need of supervision, child has lived with grandparents for a minimum of 6 out of the preceding 24 momths of filing. Adoption ends the possibility of Grandparent visitation UNLESS adoption is by step parent of child.
