    Mother kept personal belonging when thrown out
    My mother throw me out because she didn't like the fact I was bi and dating guys and anyway she throw my clothes in the yard so I got that back but now I renting a room with a friend and I went back to get the rest of my things and she won't give them back, I went to the police they said they could talk to her but they can't make her give it back so they talk to her and she admitted she had my thing and she isn't going to give them back so the police told me the only way is to have a judge make her but I don't have the money to have a judge do that what can I do? Will I get introble if I go over there and take my things back? The police seem to care less what going on so I don't think I'll get into trouble but what are my options?

    The only money you need is the filing fee in your local Small Claims Court. Then they will schedule a trial, make a decision, award (hopefully) the return of your belongings or a money judgment against your mother.

    Yes, if you go onto her property, particularly since the Police are involved, you can be arrested for trespassing and whatever stealing is called in your State.

    The trouble with "your things" at your moms is often she may have bought them, so while you used them, where they really hers? This is the issue I know when my son left home, he had some silly idea the bedroom set was his, I had bought it years before, he thought the car I paid for that he used was his, my name on the title. He thought that cell phone I was paying for was his??

    So be sure you paid for "YOUR" stuff and have a way to prove it in court also

    How old are you? Have you always lived at home, or have you been back and forth between her place and living other places? Also, when did the "throwing out" occur?

    Oh yes, and what is it you're after? Big stuff, furniture, etc? Or just stuff like pictures, toiletries, papers, books?

    Your previous posts refer to your parents, both your father and your mother. I question why this current problem involves only your mother.

    I don't want the furniture I just want my TV, ps3, laptop, PC, and my autographs posters, the TV ps3 and laptop were christmas gift from a few years ago and the PC and autographed posters I paid for and the laptop she bought had broke and when I sent it back the place she got it I had to pay another 200 for another one because they didn't have anymore of that model. I lived with my mom and when she kicked me out she sent my clothes to my dads house and he didn't want nothing to do with me so my clothers were thrown all over the yard. I'm 18 and she throw me out on the 13th of September but I finally started renting from a friend the other day on the 24th. I don't have 71 dollars to pay to take her to small claims. I was told by people if my little brother let me in when she wasn't home and got my things then it would be stealing is that true? I hope I answered everyone's answers. Also the car is in my name but she has the title and her aunt works at the DMV and I'm afriad she'll forge my name on the title and take the car away and get away with it.

    Ok, Whilke these things were gifts, it may be hard to prove they are yours.

    And yes, even if your brother lets you in she could prosecute for theft.

    As for the car, go down to DMV immediately and ask for a replacement title.

    If she forges your name, you can have her arrested. If your brother lets you in, you can be charged, as can he.

    Small Claims Court is $71 in your area?

    Don't most small claims courts have some sort of system where you can pay less or entirely waive the filing fee if you prove you make less than a certain amount?
