    Day-care expenses
    My fiancé and I were wondering about day-care expenses. She has 2 kids with her ex-husband, and while he is in rehab he is not paying Child Support at all, which will be solved once he gets out and has to pay the back child support our lawyer has already confirmed this. What we were wondering was, will he also have to payback day-care expenses? They had an agreement in the divorce decree to each pay half, and since he is not paying will he have to pay this back as well?

    If the divorce decree specified making those payments, then yes, he would be required to make up the payments he missed.

    Depending on where this is it can differ from state to state. Best is to keep all reciepts and when he is employed again then go to family court and claim those as charges so they are sanctioned. In some states if he isn't presented with a bill for services rendered ( like medical or daycare ) in a reasonable amount of time that they have been incurred then they can be denied. So be careful with that and see if there is a time limit on it. You also may want to send him statements through registered letter of the charges. That way they can compound until such time as you can get resolution on them.

    The problem with sending him the notices is we don't know which facility he is currently in. We have asked his mother and father and they refuse to tell her, we just don't feel its right that they refuse to tell us this information because they know we are "going to take his kids away"

    You can send them registered mail to his last known address. If he put in a change of address form with the post office or had his mail put on hold it will find him.

    The Court will enforce any Orders when he is released.

    To be sure, ask your Attorney.
