    How can I get a parent on abandonment even though they pay child support?
    My niese's father has not seen her in 3 years and I wanted to now how to get him on abandonment even though he is court ordered to pay child support? He has not even made any kind of effort to come and see his daughter at all. Please I need your help.

    No, you can not force anyone to see their child. And even if he is not paying, that is normally not abandoment in most US states. It is just a dead beat dad and you would have to keep fighting for child support.

    What state are you in? As said most states don't consider not seeing their child to be abandonment. Has he paid child support? If he has paid any child support in the last year then in no state can you "get him on abandonment" that is a criminal charge for when someone leaves a child at a bus stop or the like with out any one to care for them. What are you trying to accomplish? We might be able to help you figure out another way depending on how reasonable it is.

    My mother has custody of his daughter and has had custody of her since she was a year old and ever since she was a year old he has not went to see his daughter at all and my mother is trying to see what she can do to get it to where he has to sign off all rights to her since he does not want anything to do with her anyway.

    Well basically that won't happen. You never mentioned what state you are in. For more specific information we need to know that there are members from all around the country (as well as other countries) but we need a location in order to apply local laws.

    My mother lives in Oswego, New York. If you want to talk to my mother about this matter you can email her derectly at [EMAIL ADDRESSES REMOVED FOR PRIVACY]. He has been paying child support cause it comes out of his pay checks each week but he has not seen his daughter in 4 years. He has not even called to talk to his daughter. My mother has Yahoo messenger and he nows her screen name on Yahoo and he will not even talk to my mother or anything even on Yahoo. So she is asking for some help in this to have his name waved from his daughter for good since he has shown no kind of effert at all what so ever to be in contact with his daughter.

    You will get answers on this board - please don't post email addresses. It can also be dangerous. Who knows who is reading these boards?

    In NYS it is almost impossible to get a declaration of abandonment. As long as he is paying support he has not abandoned his daughter.

    You cannot force anyone to visit with his/her child. You CAN force them to support the child, which is what he has done.

    What benefit do you see to you, your mother or the child if you could get a legal ruling that he has abandoned the child?

    I am also in NYS.

    The fact remains that he didn't abandon the child. He dosen't have to visit or talk to the child he has done his part by paying support. I know it can seem unfair for the child not to know him but that is his choice. There is no case here to have his rights terminated either.
