    Can a dealership cancel my contract for them not wanting to waste any more money on fixing the car within the 30 day warranty? When I purchased the car I didn't test drive it and took it home but it had some problems so I took it back the next day. :confused:

    On Aug 31, 2008 I purchased a car under my moms name for her good credit. We didn't test drive the car big mistake. We trusted the sales man, well we took it home that same day and found a vibration when I made a left turn or right turn so I took it back the next day and they said they would fix it in two days, two days past and I went back to dealership and he notified me that the car was not in the lot because they were going to do something else to it this was on a Friday I went back on Monday to pick up the car to be exact is a 2003 Nissan Murano and this time my boyfriend check it to see if they had fixed the problem, well they didn't it had the same vibration as before the mechanic tolled us that it was normal because the motor is so heavy that it hits when making turns we did not believe him, so I took it to the Nissan Dealer and they check it they said that the vibration on the car was not normal and made a document that notified the dealer were I purchased the car that the car was not in good shape. So I took back the car and showed them the document and the sales man said that he spoke with the owner and the owner said he did not want to put any more money on the car to cancel the contract which I agreed to because of the car having problems. He gave me a DMV document for my mom to sign so she could be taken of the title of the car so she did. I ask for my refund on my deposit $500.00 He said that they needed to file the DMV paper work and then they would have my check ready. I asked for a paper something indicating that I was going to get my money back and the sales man said he couldn't do that to trust them I was going to get my money back on Monday the check was going to be ready, I went back on Monday and they tolled me that the check was ready but not signed by the owner to call back tomorrow I called back they gave me the same excuse he will call me when the check is ready I been like this for 4 days now and I don't know what to do. I am in a desperate situation any advice would be much appreciated. Thank you.

    It's GOOD that you gave them back the car. Sounds like a piece of crap.

    Go down TODAY to your local courthouse and file a small claims lawsuit against the dealer for your money. It'll cost you about $50. Follow the instructions for serving them, and then wait. Don't talk to them till your sure they've been served. They'll have a check for you. Demand that they pay your court costs too.

    If they don't come around, tell the judge. You'll win, but I doubt it'll get that far.
