    Change of VisaStatus from F1 to H1B
    I am interested in knowing the following:
    1. Spouse in USA on H1B, can I file a independent H1B in India? I would also like to know that can someone file B1/B2 for going to USA to write a exam which is not available in India with the same status of spouse in USA on H1b.

    2. Spouse in USA on F1 can I file independent B1/B2 first to write license exam in USA and then come back and apply for H1B.

    3. Spouse in USA on H1B and I go as a dependent to USA. Write my license exam there and then can I apply for independent H1B. If yes can I do this sitting in USA.

    I work for recruitment company who arranges job overseas. But not getting the answer. Situation I need to address is one of my candidates husband has gone from here on B1/B2 to USA and he got his status changed there by joining some study course to F1. NOw she wants to leave on B1/B2 to write License exam. Which is available in USA but was rejected because of her husband. She was given blue form.

    Her only choice is to apply for F-2. She may be eligible for H-1B if she can find the sponsor. It's best to advise all your candidates not to file for change of status while in US as it causes consequences to spouse and family members. Though it's doable but not recommended.

    Schedule A is not a visa.. it's the first category of employment based visa, i.e. medical staff, nurses, etc.
