    Hello, I am hoping someone can clarify this whole probate on an estate thing for me. If someone is willed a house and property at what time are they supposed to be able to begin living there?

    The situation is that a mother, recently deceased, left a house and some land to her son, with the balance of the property to be sold at auction, along with other items. The house is vacant, a sister is the executor of the estate, but will not allow him to move into the house. It is fully understood that everything has to go through probate and the deed could take months, but what would have happened if he was already living there? Would he have to move out until the estate was settled?

    Is this a legal precedent or just a family feud that they don't want him in the house?
