    Divorce after long separation
    We have been separated for 20 years and would like to finally get divorced. We both live separate lives in PA and have no dependent children, or property to split etc. Is their any easier way to file for divorce, since we have not been together for 20 years? And can we file ourselves for this divorce? This is a mutual agreement.

    Are you legally separated or just living apart?

    One of the grounds for divorce in Pennsylvania absolutely fits your situation: "The court may decree a divorce where it is alleged that the marriage is irretrievably broken and 90 days have elapsed from the date of filing or when the marriage is irretrievably broken and an affidavit has been filed alleging that the parties have lived separate and apart for a period of at least two years."

    You do not need an Attorney to file for divorce but it certainly makes it faster and easier because you are undoubtedly not familiar with the formats, requirements, legalities.

    An Attorney will also make sure that EVERYTHING is covered and you don't find out 10 years from now that you did not address something which has become an issue - and that happens all the time.

    Since you have nothing to split and its non contested it should not be a problem. You have grounds for a no fault divorce. PA law states: Irretrievable breakdown of the marriage with the spouses living separate and apart without cohabitation for 2 years - which is clearly you two.

    It is very easy for both of you to hire one attorney and let them do the paper work and file, You share the cost, and it should not be much over 300 or 400 dollars

    My finance is married to another woman but he's been separated for 3 years we been together for 4 years my question is how long will the process take he just started it about 2 months ago and I wanted to know how long should I expect the divorce to be final. He's been separted for 3 years now and moved on with another family does this make it faster?

    No, his "moving on with another family" does not make the process go faster. In fact, it can slow it down because it changes the financial aspect.

    Just as a side note - he's a married man. You are his girlfriend. You are not his fiancé.

    Is he legally separated and that will be turned into a divorce or does he simply live apart from his wife?

    My ex-husband and I got divorced in PA 7 years ago. We got an attorney and paid $500. It would have only been $200 but I wanted a settlement in writing stating our dog was going to be mine, which furniture would go to each of us and other things. I felt the settlement was a good idea because then it was in writing and filed in the courthouse. We never had to go to court. Our divorce was completely amicable so I have no idea if that's why we didn't have to go to court.
