    Me and my fiance' have been living together since I was 16. My dads in jail and my moms completely fine with this even though he's older then me. She accually absolutely loves him. She's already said shell sign for us to be married when ever we want. We live in California and were planning on waiting until I was 18 (im 17 now ill be 18 July 2009). Well I ended up getting pregnant 2 months before my 17th birthday. My question is that if we don't want to get married until after I'm 18 like wanted to in the first place, will they take the baby or put him in jail?

    It was statutary rape when the older man started sleeping with you, that's technical. They won't take your baby, unless for some reason they prove you unfit. Otherwise I believe someone has to press charges for him to have to face jail. Doesn't sound like that's going to happen so you should be fine.

    He was 23 when I met him and now he's 24. I know it sounds really bad but having f'd up parents kind of made me grow up a little quicker then ussual. Also I have a job as does he, we have our own place with my name on the lease agree meant (I'm just a 'tedent' or whatever)we take care of all of our food, gas, clothes, we have health insurance and he takes me to all my dr apointments. We've both proven we can take care of ourselves and this child. I'm easily able to get emancipated (though it won't do much I still have to have my mom 4 things like signing to get married, join the military etc ect). But I'm just worried that some judges might not be so open minded and fall back on stachitory rape laws

    Before a Judge would even get involved somebody would have to file a complaint, a criminal charge. I don't see that happening from what you've described.

    In case this subject comes up again, you are/were UNDER age. He is of LEGAL age.

    Love, open mindedness has not a thing to do with it. It's about the law, someone has to file charges. No one is going to file charges. No one is going to take your baby. One question for you... are you still in school?

    I've already graduated and plan on going to collage part time or take online courses after I have the baby when he's about to hit his first birthday. Also, my coworker said the hospital tried to file charges on her younger sister in the same situation.

    If you are worried about your boyfriend going to jail, about someone in the medical field "turning him in," your mother will consent to marriage - why don't you get married now and end that part of the problem - ?
