Ask Me Help Desk - Is there anything I can do about this case?

I am 19 years old, and was charged with distribution of ecstasy at 18, when I had done the crime at 17.

Sorry this is a huge situation, I'll try to make a long story short.

My Friend was dealing ecstasy, and she had asked me to give this man the pills for money. I did so, and 3 months later it was found out that the man worked for DRANO and was an undercover cop. They had busted her, and she had told on everyone that was involved with her. Including me.

Now, here's the tricky part. She came out with a possession charge, and I have 3 felonies now. Is that possible when she actually did more of the crime then myself?

Also The judge had given me HYTA probation, which means my felonies should not show up, but they do. I have regular probation. So it shows up. I just got fired from a job for it, and cannot find a job.

I am only 19, and want to go to school to be a therapist or something. I want to make something of myself. Are these charges going to stick with me for the rest of my life? And is it okay that the courts did this to me?

Please only post the same question once - different posts with different facts are hard to follow, let alone answer.

If you want to know if what the Courts "did to you," that's up to the Courts. I would assume there was a trial or a plea?

As far as employment - first you have to get off probation. In some States you can apply to have your record expunged. Different time frames, different steps, in different States.

As far as anything that requires a license, particularly in the health care field, you are going to have a difficult time passing the criminal and background check.

Unfortunately, that's the hard fact of things when you are 19 with 3 felonies, on probation..

Of course often the person who goes to the police first and gives up all the evidence works out the best deal. Happens every day. Welcome to the criminal justice system. It is legal, not fair so stop expecting anything fair..

Next most likley if the judge is going to seal it, it will not seal till after all the probation is finished but that is just a though. But if it is not sealed, it will be with you forever or till you get it explunged years from now.

And the Judge does not have to sentence the same parties to the same crime to the same sentence - I've seen past record, attitude, employment, many factors enter into things.

People post here all the time that "I have a friend" or "my cousin's wife's neighbor" told me and they are all different stories. Some don't make sense but I would bet some are true.

As you said - it's the legal system.

Chuck and Judy are correct on this. Basically she got off easier as she happily turned CI and turned everyone in so she'd get a better deal. The fact you dealt to an undercover nailed you good. 3 felonies are probably going to stick with you a long time. Hopefully you will do your probation and the judge will then seal your record. But as Judy pointed out the health care industry does do extensive background checks and you more than likely will be found out.

Too bad you lost your job over this, but you must remember that drugs are illegal and what you did was illegal. Just because you are a teenager is certainly no excuse. What difference does it make if it was estacy or heroin? What difference does it make if she got less of a punishment than you did? None that's what difference. If you can't do the time, don't do the crime. When you play you pay.

Hopefully you will not violate your probation and land up in jail doing your entire sentence behind bars. 3 felonies is serious stuff regardless of how old you are.
