My son is 14 years old , he has not seen his bio father in 10 years . He doesn't get phone calls , emails , cards , or letters from him either . He hasn't paid support in over 2 years ! And when he does pay , it's not an all the time thing . Can't I get his rights taken away being as he has NOTHING to do with my son ? Does he have any rights as it stands right now ? He is not involved , or hasn't been for the greater part of his life .

What state are you in? In most states it is an easy no you can't. What you can do is go back to court to have the support enforced. If that dosen't work contact an agency like support kids they will go to work for you to collect money and won't cost you a dime out of pocket.

Live in PA . I have tried many many times for DOMESTICS to hold him responsible and make him pay his support . It's a lost cause ! They put warrants out for him and then they do nothing . I've had it up to here with them !

The answer is no, you can't just take his rights away. If you read the hundreds of other threads that ask this same question, you would have learned that TPRs are generally granted only to clear the way for an adoption or if the parent is a danger to the child. I don't see either case here.

Basically, since he's not exercising the rights he has, then terminating is not really going to get you anything if you could.

It's true that there are hundereds of other threads on this same topic. You can read some of them if you want to learn more but basically what you will learn is that you can not have his rights terminated. You can call an agency (like I pointed out earlier) for collecting support. Do you have full physical custody? If not then you can use the fact that he hasn't been using his visitation to get a modification so that you do have full physical custody but other than that it's just one of those lessons that people seem to have to learn the hard way a lot of times.

The reason I mentioned the hundreds of other threads is so you can see that there are many people in similar situations and learn from their experiences. The idea was to help you.

Yes, I am sorry if you don't want to hear a correct answer, but merely want someone to agree with you.

Merely not seeing a child and not paying is not grounds to get rights taken away. And he has every right that the court has given him, he just appears not to want to use them. So with that, he is not bothering you, you don't bother him, and it is about what you want. Besides that you follow up with the court to chase him down for child support

You're not getting any money anyway SO I'd get a collection agency (if you have a Judgment for the past due amount), agree to pay them a percentage - one in my area takes 20% instead of their usual 33-3/3% or 40% - and THEY hunt him down and collect. Ruthlessly and relentlessly.
