FBI background check does not cover overseas records. However, USCIS request criminal clearance from all the countries you've resided over 6 months. So this issue will come up. What you should do is retain an immigration attorney to help with a waiver. Even it's little issue, but if it's interpreted as crime involves moral turpitude, you might be in trouble.

Of course if you listed it, when asked about any criminal conviction, it shouild not even matter. Also if this is from the country you are coming from, they run a check there.

FBI do not run background check overseas but USCIS requires that you must submit criminal clearance from every countries you've lived in the past.
