I am divorcing my Immigrant husband before 1 yr anniversary
He is on a Conditional Visa and we have filed for divorce based on IRRECONCIALABLE DIFFERENCES in New Jersey. Ours was never really a bona fide marriage since it always seemed he kept going back to his ex girlfriend. I cared about him and forgave him the first time but no more. We had a lease together and filed joint taxes. We also had a joint bank account that we hardly ever used along with our joint cell phone bills. That's it. We never purchased anything together and there are no credit card bills in our names. He has a few pictures of us with friends although we never traveled anywhere. I'm aware he can file a waiver if he can prove he married me in good faith...
How can he prove this?
Would all of the above I mentioned be sufficient for the Immigration officer to believe he married me in good faith?
Can I do anything to let Immigration know that I believe he used me to be able to stay here?
I would like to send a copy of our divorce papers along with a personal statement but will this remain in his file for the deciding Immigration officer to review along with whatever "proof" of "bonafide" marriage he decides to bring along?
What if he remarries another US citizen?
How tough will it be for him to prove his 2nd marriage is for real at that time?
I guess I am so upset that I'd like for things to be more difficult for him. What do I do?
