Child Endangerment charge letting 15yr old drive due to me being ill
My daughter and I were on the way to the store to get medication.Because I had a migraine, on the way I realized that I could not drive due to some vision loss. So, 3 minutes from the store I let her drive. She has taken driving classes but does not have her permit. When she was leaving the lot she backed into a vehicle, we got out and there was very little damage. A man came up and looked at the car and acted like it was his. I spoke to him (he worked there) and asked if he minded if I talked to him in the am because of my migraine. He said yes,I see you all the time here and the car is driveable. So, we go home. I hear a knock at the door and it is a police officer saying he was there to investigate a hit and run and then he said he was going to arrest me for child endangerment because I let me 15 1/2 yr old daughter drive. He said he didn't believe I had migraines and lots of other unnecessary things. I understand that she should not have been driving but seriously it was safer than me driving. In the state of Indiana what is the law regarding child endangerment? I looked up everything about the hit and run claim and I am fine there. I appreciate any input. I really am a good Mom, I feel so awful about this.

    Thank you

Do you have a lawyer? If not I would get one. Your situation dosen't generally happen so really isn't covered under any child endangerment laws it is more open for interpretation by the judge. I won't lie and say there won't be any problems for you because she didn't even have a permit but its not like they are going to take her away either. Especially if you have a dr that will testify or give legal letter to the fact that you have these migraines on a regular basis and are prescribed meds for them and there is no previous record of you being complained about as an unfit mother nor any actions by her that would not show nicely (suspensions from school etc.). I would expect there to be a delay in her ability to get her drivers license though because Indiana is really cracking down on driving laws so the judge may order her to be 18 before she can start driving.

Child endagerment is just about anything CPS and the courts want to call it.

The minute those words came out of his mouth (*police) you don't say another word to him or anyone and get an attorney before you say another word. First no evidence she was driving?? except you wanting to tell everyone she was. So you were confused and perhaps you backed into that car?? Or you merely refuse to make any statements and make them prove everything.?

Get an attorney, this can turn serious very fast if they are looking at that
