Ask Me Help Desk - Additional amounts on child support

In January of this year an order was written by a New York child support magistrate ordering $882 monthly. This amount was based on my retirement income of approximately $2000 per month... I am 60 yrs old and retired from the Marines as well as the Postal Service. The magistrate ordered this amount after imputing an amount of $200 per week income based on past history. I left a job in January of this year to relocate and subsequently I remarried. So... I pay child support on an amount of money ($10,400 annually) I don't receive. To further frustrate this issue, Child Support Enforcement in Chenango County adds an "additional amount" of $441 to the income execution order which reduces my income to below poverty limits. I was instructed to write to the Support Collection Unit since they don't accept calls. All calls to their office are routed to Albany. It was in talking to the Albany Support Collection Office where I received instructions to request a modification or elimination of these additional amounts from the local office in Norwich. Their answer to me was that after review, no reduction would be given in spite of the amounts taken reducing my income far below the self-support reserve. Their decision was followed by a violation order "upon investigation and belief" by a Support Investigator that an arrearage exists of $882 on August 1st of this year when in fact an amount significantly greater then the ordered $882 was garnished from my retirement income as usual on August 1st and each month preceding that date since my retirement from the Postal Service in 2005. What can I do?:confused:

You need to sent proof of the deduction from your retirement or bringing it in is better if they allow that where you are. I know in my state they generally say if you can bring it in they like that better but if they don't allow phone calls then not sure they would take drop offs either. How much longer are you ordered to pay? I ask because you may end up having to hire a lawyer and end up paying more than you would save by the time it is all said and done.

If you got money to marry another woman then $882 is nothing. Remember your kids come first before anybody :mad:
