    Confused about sueing?
    Hi was recently charged with a felony 4th degree grand larceny over a 400 dollar gas charge. I then had to hire a lawyer to bring it down to a misdemeanor petty larceny. They had withheld my check and w2's for several months after I reported it to labor department. All of this because I quit my job after getting into a car accident, did not feel comfy driving so I resigned my position as a driver and offered to work at the warehouse they fired me and said I was just a driver. After court is all done can I sue them for emotional distress. Cost of the lawyer and loss of my vehicle I was at at work 2 hours early my last day I was the delivery driver and I also picked and packed orders for my delivery they paid me my money that they with held before my 1st enitial court date. So if I was just a delivery driver NOT a ware house worker, got in my accident that same day because they refused to let me leave after my deliveries were all done at 2pm did not leave until 5pm, left to ny got in my accident at almost 10 pm on way to nyc from rochester ny for a weekend getaway showed no simpathy what so ever.

    I don't quite understand what happened here.

    Employment is "at will." You can be fired because your employer doesn't like the color of your socks - unless, of course, there is a union.

    You can't say, "I don't want to do this any more. I'd rather do that." They hired you for one job and it's not your choice to work that job or take another one.

    I think you've caused your own emotional distress and have no lawsuit here.
