My daughter is almost 10 years old, her "father" has been in prison for murder since I was pregnant with her.. Has never met her. I have been with my current husband for 8 1/2 years. He has raised her as his, provided for her, taken care of her. She goes by his last name in school.. she actually has my maiden name. She asked us if he could adopt her and make it so he's her "real" dad, so this isn't something I just conjured up in my head and thought was a brilliant idea. I just don't know how to go about it, I mean do I have to get her biological father's rights taken away or what? Any help would be great. :)

Depeds on where you live, in some US states, if a person is in prison for seroiuis crimes, you can have their rights taken away. Your first step will be an attrney, if you get his rights taken away, then the new husband can adopt
