    Mother wants to give up rights, What to do?
    My ex and I had a son, he is 3yrs old. It was a messed up situation from the beginning. I did not know of the pregnancy until she was 8 months pregnant. We weren't together when it happened. I had moved on and was with my current fiencee. The first 3 months she did not want me in his life, My fiencee and I had taken her to court to get partial custody, and I won't I got Majority custody. Ever since then she has been seeing the child less and less. Its to the point where there's no phone calls, and does not see the child. She is so far in the arrears on Child support and she does not want to see the child. She is begging me to find out a way for her to sign over her rights completely. My feincee and I are all for it. We are getting married next month and we want to know how to legally go about to do this. I have read several articles, that if I have my fiencee adopt the child his biological mother can give up her rights. Is this correct? And will child suport be dropped including the arrears? That is one of her biggest concerns.

    Yes, one of the two reasons a TPR is granted is to clear the way for an adoption. However, the courts would generally require that you be married first and there may be a minimum time you have to be married.

    You will need an attorney to preapre the adoption papers. So I would check with one to see what requirements you have to meet first. Once you meet them, then you can apply for adoption whiohc would include terminating the bio mother's rights. This would end her support obligation as well.
