I am looking at moving to another state in the near future, but need to find out first if I can move my children out of the state we currently live in. If it is possible how hard is it to do this?

If there is a child custody arrangement in place, you will need to adhere to that unless your ex will allow the move to take place. Then you are likely to have holiday and school vacation time where the children spend time with their father.

This varies depending who has custody and the state you live in. In my case, I am the custodial parent. I can move with the kids, but I would have to notify him in writing at least 30 days prior to the move. Then, he can go to court to try to stop me from moving them... or just allow the move. It may be different in your state and each has their own exclusions.

Depends on what state you live in and any current court orders. CA is pretty strict about even leaving the current county you are both in. In my case, I left the county and basically lost ALL custody.

The answer to this question is found in your divorce/custody/visitation agreement. Generally, if there is a court ordered visitation schedule and your move will mean a change in that schedule, then you will need the permission of the court to make a move. If your ex wants to block the move they can. If, however, there is no court ordered schedule or custody agreement, then you would normally be free to move.

What does your divorce settlement/agreement/judgment say? You will probably have to go back to Court and ask to leave if it is not covered.

I agree with the other posters, it depends if you are the custodial parent. If so, most agreements require you providing your ex with notification that you are planning on leaving the state. Depending on your state's laws, the agreement may need to be changed, again all depending on what is in the original agreement.

I recommend you review the custody agreement/paperwork to see if there are any notes about moving out of state. If you cannot find any, contact your lawyer and discuss this with him before making any moves, just to be safe.
