    Replacing Property Manager
    Recently I have been appointed Power of Attorney for a 2 family dwelling. The old property manager is residing in the household and he is not paying rent, not even contributing to the household bills. He is not in the deed nor has any ties to the house. He has stated that he needs to remain in the house until January 2009.

    I am fearful for my life and my family. Can you help me please?

    Ok why are you fearful,

    Next you have power of attorney from some person ( owner of property) to over see the business affairs of the 2 family dwelling.

    If you are now the landlord, who is the new property manager?
    YOU?? I hope not, since if you don't know what to do, you don't need to be a property manager.

    So you evict them? Unless they are the guest of a resident of the house, you give them notice to be out, and if they don't move you go to court to evict them.

    Or you set up a monthly rent they owe ad give them notice o new rent since they are no longer the property manager.

    IF you have real reason to fear them, go get a restraining order and protectivite order from the court.

    I would begin eviction proceedings immediately. You may need to seek the advice of an attorney. Does this "tenant" have a current lease?
