    Unwed Parents. What precautions can I take?
    I have a three year old child. I am still in custody battles with his father. I have since met a wonderful man and though we have had our ups and downs we work well together and have amny of the same dreams and goals. We recently became pregnant despite precautions but we are not ready to get married. What legal precautions can I take to make sure he gets to decided what happens to me and or the baby in child birth or after if necessary rather than my nother or father who I am estranged from?

    I need something foolproof of course.

    You need to draw up a living will to bring with you to the hospital when you go into labor. Go to a lawyer and have them draw it up that way you can be sure that everything is covered for your care. Your parents don't have any legal right to your child and would have to take him to court to prove that he isn't the father or is unfit for them to take the baby.

    Speak with someone in social services at the hospital; they should have loads of information about a durable power of attorney that allows someone to make health care decisions in the event you are not able. You may want to prepare an affidavit of paternity that sets forth the identity of the father. In the event of your demise, he is the surviving natural parent and will have sole custody of the baby.     Also make it clear that he is the father and will sign the because as the legal father. Once that's done he will have primary rights to the child should anything happen to you.
