I live in Georgia and My ex-wife has previously agreed to allow me to sign my rights over and not except my child support. If I'm able to sign my rights over and eliminate child support, how would I go about doing that in the state of Georgia? Please no opinions just facts.

In the state of Georgia you can't do that.

The state first will hold you liable for repayment of any state money if the mother and/or the child ever receives any government assistance so you will be held liable for that.

Also seldon do they even let you sign over your rights, but if they do, you are still liable for child support, now unofficially your ex may not take you to court for payment if you don't pay, but then 14 years from now they may change their minds also.


Now if she has a new partner, and that partner wants to adopt, then you can sign over your rights and get out of the child support, since the new husband will become liable

You can't - you can not pay if she agrees, you can not visit with the child but you cannot surrender your rights unless there is someone willing to adopt and support the child.

In the event the mother goes on public assistance you are responsible for reimbursing the State.

Its very nice of your ex to be so generous, but I wonder if she knows she is making an empty gesture? She may know that the courts will not grant a TPR, even if she agrees. So she loses nothing in making the offer.

Is there a step dad wanting to adopt? If so then yes you can sign over your rights and not pay support. All you have to do is get an adoption lawyer and he/she will do the paperwork and there will probably be one court appearance and it will all be done. If there isn't someone waiting to adopt then no you can't.
