My son's father has made no efffort or contact with his son in almost a year. And my son is devastated. But is just now starting to get over it and move on. How do I keep his father out of his life. My son has made attempts to contact his father with no response.

What does the custody order say? You basically cannot terminate parental rights.

Also the State is important.

Merely not visiting or not paying child support does not allow you to take his rights away, you can go back to court and try to have his right to visit limited.

Effectively, he has relinquished his rights, just not legally. But the problem is the courts are very reluctant to grant a TPR especially involuntarily.

I would save your money and just leave things as they are. If he tries to come back into your son's life you can deal with it then.

There is no custody order we were never married and there was never any custody order. I have always had full custody of my son. The state is Pennsylvania

Also was wondering if the fact that he is not an american citizen hinder him in having any rights as far as my son is concerned.

So he dosen't have any court ordered visitation? Then there wouldn't be a support order either. Which means at this point if he does want to come back you don't really have to let him you can tell him to go to court for visitation.

Then you have custody and control of your son. Until the father takes you to Court for visitation and wins you do not have to allow contact.

No, his rights as a father have nothing to do with his citizenship - I see this could become a problem if the father gets visitation and wants to take the son out of the country so, if he does file, you will have to be prepared to ask for limited visitation or supervised visitation.
