    Dad wants to take kids back to home state and file for custody?
    :confused: My brother moved to Arizona from Washington with his wife and kids and 2 years there she had a affair and has now kicked my brother out. She no longer wants to be with him. No papers have been filed and my brother wants to take his kids and drive back home to Washington where all the family is. He wants to know if he can drive them home and then file for custody in Washington? Is that legal? What should he do?
    Please help if you have any answers!!

    To avoid legal problems it is best if he files for primary custody in Arizona and get it settled before taking matters on himself and doing something like that.

    I believe that you have to have a legal address of 6 months to a year in the city/county before you can file for divorce. With Custody I believe that it's the children's legal address for the past 6 months they go by.
