    30 day notice due on day of rent per agreement-binding?
    Live in San Francisco. Gave manager of building a 30 day notice to vacate. Put in managers mail box. Landlord says manager received our notice 2 days after rent due date. Lanlord says because agreement states notice to vacate must be due on rent due date,thus unaacceptable and they are charging another months rent. I presume they will deduct our dedposit. We put our rent checks in managers mail box-thats our way of doing business with the building.
    Is the 30 day notice due on rent date enforceable? Small claims court the only way to collect our deposit?

    I am not sure what you are saying can you give dates something like
    I put the 30 day notice in mailbox on 7/28
    Rent was due 8/1
    We want to be out by 9/1
    etc...

    Deposit is not meant to be used toward last month rent.

    We paid our rent for July 20th to aug 19th. Our lanlord is now saying since our rent was due on the 20th,our letter to vacate stated July 20th, but his manager received it on the 22nd,placed in manager mail box,he wants to charge us for August 20th to September 19th and withhold our security deposit. The month to month agreement states must give 30 days notice to vacate on or before rental due date. The manger said when we gave the keys,we should give them 30 days notice in September! We have moved out.

    I have a tenant on a month to month lease. I want this tenant out by Oct. 1, 2008. How do I go about doing this and when?
