    More on mom and daughter
    OK, my mom sold me her 03 altima. It was a yr old when I started making monthly pyments. She ask me what I could afford as a pyment. I told her I could do 350.00. She stated OK . The pyment was 472.00. She offered to pay the diffrence every month. She was helping me out. She did this about a year, then told me, "i would like you to pay the 472.00 from now on and dont worry about the diffrence i have been paying, just start paying the 472." those were the exact words

    Okay then what is the problem as long as you have proof you are making the payments and you can afford it then I don't understand how she plans on suing you. I mean she can threaten to and she can actually go and sue you for some reason but in order for her to win she would have to have a valid reason to sue you and so far you have not explained that.

    Yes car is almost paid off 4 more pyments now she is saying she wants the diffrence she paid for a year. When I was paying 350.

    Do you have anything in writing that shows she was willing to accept paying the difference?

    You said in the original post these were her exact words
    "i would like you to pay the 472.00 from now on and dont worry about the diffrence i have been paying, just start paying the 472." those were the exact words.

    That means that she now wants you to take over the $472. But she does not expect you to pay the difference from previous months.

    And now you are saying she wants the difference.

    What is she claiming she is taking you to court for?

    No there is nothing in writing, and she is taken me to court for this diffrence . She did this all of the sudden because we had a disagreement. Its crazy.

    All you can do is let her take you to court if she is going to and hopefully the Judge believes you over her. Often when somebody is going for spiteful reasons they can't keep their story straight and the Judge sees right through it.

    How much back money is she trying to get out of you?

    Legally in your situation I think you would lose if it was a stranger that sold you the car but it being your mother I think that the Judge may look at it differently and see she is doing it for spite.

    All OP's posts on this subject should be combined - details in the other posts which are important.

    I see this whole problem is one person said this, the other person said that and the Court will have to decide. Some will depend on how the payments were made (Mom paid $X, daughter paid $X, both paid by checks. I'm amazed that the financial institution would accept two checks); some will depend on who is most believable in Court.

    She paid the pyment to finance co, and I paid her every month. She ask me when I took over pyments how much I could afford. I said 350, she said she would pay the diffrence for a while. She did for about a year, then she ask me to start maken the reg pyment of 472. She stated, don't worry about the diffrence just start payen me the whole pyment and I did. Okay we had a bid misunderstanding last week, she would not talk to me, next thing I know I get small claims papers.

    You have to just go to court and hope for the best now. The Judge will have to decide.
    She doesn't have any papers showing what she expected, you don't have any thing in writing that proves what you agreed to so the Judge will have to decide who is telling the truth.
