    Move-out notice to landlord due to failing to fix the floors
    WE have horrable holes under the lenolium in the kitchen and laundry room, have been asking to fix them since march, wrote them a letter demanding to fix it - nothing happens. One lady came and mesured the holes in June, but that was it! Then after the letter maitanance called and asked when they may come, we said anytime next week (2 weeks ago) - Nobody showed up.
    Now here is a question. I am planning to write the a 30 day move -out notice. And I don't want to pay for the rest of September (after the 17th or watever).
    How should I write a notice? I want to say that I am only moving out because they woun't fix the floors and how it's their fault that I am moving out, shell I demand on paying only the part of September I lived there? I mean what are my rights in this situation?

    Do you have a lease ? Where these holes there when you moved in ?

    It's a month-to-month lease, and no, there weren't any holes when we moved in. There was a flud before we did, so I think those holes are there because of that or because of the leaking water heater from last year (that we had to wait for 2- more weeks for them to fix)

    And do I have a right to write them less then 30 days notice due to this whole situation?

    To Whom It May Concern:
    On July, 31 I sent a note to your office along with my rent payment asking for maintenance in our house. It's been about 15 days since than and nobody showed up, as always. Maintenance called asking when we were going to be home (someone was home the whole two weeks after that letter) but no one came. Once again, there are holes in our floor, I suspect from water heater leakage from last year (they only fixed the once that was in the bedroom) and back door leakage from the rain.
    Due to this conditions we have to leave the premises. According to the lease agreement DAMAGES TO PREMISES we have a right not to give you the full 30 days move out notice. We'll vacate the house on the 8th of September and expect not to be charged for the rest of it.
