    Collection agency payment arrangements
    I have made payment arrangements with a collection agency for a bill. The total was about $5000.00. I have been making payments of $100.00 every 2 weeks since Jan 2008. I received an email approx 4 weeks ago to increase the payment. I did so by $20.00. Now I received an email stating that is not enough money and he wants a min of $500.00 a month. I cannot pay this. He has been getting consistent payments. None have been missed. The last one (8/8/08) was not made until the following tues cause I was sick and could not get my check until mon 8/11. Question being: can he now refuse the payment arrangements we agreed on? I was under the impression that as long as I am making consistent payments on time of the same amt they could not be turned down. If this is so please tell me the legal ruling so I can site it to him. He is very arrogant, belligerent and very belittling on the phone. I even saved one of his voice mails just for this reason. I cannot afford a lawyer. Thank you ahead of time. misguided

    He works off commission, he wants a bigger paycheck.

    Next time he calls, request to speak to a supervisor and explain your situation.

    Did you by chance, get your payment arrangement in writing?

    If not, as I suspect, make sure when you speak to the supervisor, to make a new arrangement, MAKE SURE YOU GET IT IN WRITING.

    Tell him you will submit the first payment upon receipt of the WRITTEN PLAN.

    If you did not get the original payment plan in writing from them, signed, sorry you did not really have any arrangement, you were lied to and cheated into paying as much as they could get out of you, and can still sue you if they want or demand more. So you get a plan in writing or don't agree to one at all.

    As has been said, unless you have a written agreement setting forth the payment arrangement and staying a Court action it's their ballgame.

    I would ask to speak to a Supervisor but if you cannot come to terms I would be prepared for a lawsuit.
