My boyfriend and I got into a 10 minute fight, yes, he did say he wanted to kill me, throw a knife in the wall (in the opposite direction) and my friend convienced me to call the police because he needed help.

He pleaded guilty, thinking it was the right thing to do. I do not know why his lawyer let him do this. He was sentenced to community corrections for 4 YEARS. He I a non resident now, but stuck in the armpit of colordo, alamosa. He has to do UA's every morning if they say to, he has completed all of his "counseling" (if you can call it that), and pay off $90 dollars a month to these monkeys. He is basically done with all the "counseling" has had no write ups, is sober, working etc. But the judge will not reconsider him, even though he said he would six months into the sentence. The judge is a prick, during our court date to get the restraining order removed he could have been searching the inter net for porn for all we know. He barely looked up, and well... he was so rude. Honest to god, it was if we were gum on his shoe. He is also the judge that screwed up the Kobi Bryant case.

So, we are stuck here in alamosa Colorado for another 3 years, where poverty is so high, I do not know why or how anyone gets by.

Do we have any means to go back to court? Does anyone know a way around this?

I don't know any way around it. I have noticed in the past 10 years or more that many Judges do go into hearing a case like their mind is already made up and anything you or your lawyer says is not going to change a thing. My Child protective services Judges did me the same way. The one Judge would stare out the window like he was high and/or daydreaming. The other Judge was a woman and she acted like she was handing her decisions down out of spite and disdain for women. The case workers lied and they even admitted to me ''Yes we lie but so what''.
His lawyer probably had him do a plea bargain or something like that because he was guilty and it was the easiest sentence he could get I would guess.

Basically since he pled guilty and did not sign any plea bargain (you did not mention one) he got what he asked for. The Judge does not have to reconsider anything if he does not want to. There is nothing in any "rule" book that I know of about judges being rude or not. It's their job to dispense justice - not to win popularity contests. You may have interpreted his demeanor as "rude" but I'm sure it was more of a typical judge demeanor. Usually judges don't joke around much in a courtroom, if ever, when determining whether to lift a previous order of theirs.

Also, your terms of "monkeys" "prick" "looking at porn" show how little respect you have for the judicial system. Your boyfriend pled guilty. His lawyer let him do this. You should chastise the lawyer and your boyfriend - not the judge - regardless if he is Mr. Zero Personality.

The FEW GOOD Judges I have had were fair and very reserved like you would picture a Judge to be, even though they were not trying to win any popularity contest or joking around at all. I say fair even if I did not agree with their decision at least I could see they listened and heard. But like Twinkledooter said there wasn't much of a decision to be made because it was a cut and dry thing by the time his case got to the Court room since he plead guilty.
By plea bargain or whatever I meant his lawyer probably considered all the options such as just plead guilty, plea bargain or whatever and told him which one was the easiest route with the minimal 'sentence'.

Well I am sorry for a couple things, first that you as most abused women decided to stay with a man that would throw a knife and threaten to kill you. This is a syndome that so many battered women fall into.

But don't know why you are surprised he was guility, and had he not reached a plea agreement most likely he would have done hard time for domestic violence. So you should thank the DA and his attorney for working on a deal that keep him out of long term prison.

Next if all of his fines and counseling is over, one can request a transfer to another location, not getting off probation but a transfer.
Almost never until at least 1/2 but often 3/4 of the probation is over will they consider letting someone off probation.

Also another thing how long have you been together and do you have any children?

He said he wanted to kill you and threw a knife (although he threw it in the opposite direction), you reported the incident to the Police, he was arrested and entered a guilty plea.

I don't know why you're blaming the Judge - domestic violence is taken very, very seriously now and he entered a guilty plea.
