I live in South Florida and have allowed an adult male and his girlfriend to temporarily rent a room at my home. There is a verbal agreement that the couple will pay $500.00/mo. For expenses and other things incured each month. The individuals have only paid a portion of the agreed amount for the past 2 months and I want them to leave. The police were called and l was told that they can not be removed without an eviction notice filed with the court. Is this true and is their anything else I can do to forece them to leave. Thank you.

Yes you have to give them a written eviction and go through the legal procedures then when the time runs out and they still refuse to leave the sheriff or constables will make them leave
Police for the most part are not involved in evicting people, especially before the legal procedures.

Yes, and should have on the first month, give them official notice then you will have to file for an eviction in housing court. And hope they don't tear up or steal too much as all this happens

There's a "sticky" at the top of this forum with a link to each state's landlord/tenant laws. It will tell you how much notice you need to give them before starting eviction proceedings. Also, if you call your local magistrate / JP court (probably wherever small claims court is) they will have paperwork and tell you what needs to be done before you can file to evict.

I agree with what everyone else says above. But act quickly, the forms you need are online and since they live with you it should be easy to put a notice up on their door. But do it soon, renters actually have a lot of rights, and it will take at least another month to get things going with the courts, and the dates, etc. Next time you rent, get a lease, first last and deposit no matter what, even if it is a friend.

It took me 3 months and 5grand later to get my deadbeat tenants out last year. I have some great tenants now, but I put in the new lease that as the landlord I am above the law, and court system. If rent it not paid by the 10th of the month on the 11th the locks will be changed and the tenants can pick their belongings up on the corner. I do not know if that statement will hold up in court, but they agreed to it and it will happen. They can then spend their money trying to get back into the place. Be careful who you rent to.

How large is your bank account?

If you do what you have posted here, you will end up being the one trying to find
A place to rent.

You really should watch the old movie Pacific Heights with Matthew Modine, Michael Keaton, and Melanie Griffith. And, you should really become more familiar with the landlord tenant laws where you live.

Seriously, an action like this could end up costing you everything you own.
