    Asset Acceptance no proof of valid debt
    I have read so many things on Asset Acceptance and know that they don't always follow the rules. I found them on my credit report recently. The debt is from 2002 but shows it was opened in 2004. Is that when they acquired it? They had never contacted me until after I had called them about 4 months ago. It is from an old SWBell account. The SOL in Kansas for this is 3 years. I told them that I had not received any letters until I made contact. I still have the same address and phone number. The last person I talked to looked up the SOL and agreed that time was up but she said it would still be on my credit report. Now today someone called and said that they will continue to call until the debt is paid. I have asked for proof of the debt and this woman said that it is only 149.00 and she wasn't going to go through the paperwork for that amount. She also said that it is my responsibility to prove that it was paid. I told her that if I would've known about it 4 years ago then I probably could have proven it. Am I wrong about the collection calls? Can they still call me about this even though it is so old? I filed a dispute with experian and they investigated it. The report says that this account is to remain on record until October 08. Does this mean it comes off my record in October? Please tell me what to say to them. They have an answer for everything I say. Thank you in advance for your help!

    Send them a DV request via US Mail. Or, since it is past SOL and it due to be removed from your report in a few months, you can send them a cease and desist.

    They can try to collect forever, even when past reporting time and SOL.

    However, if you send the cease and desist, they must obey or they are in violation of FDCPA.

    Keep hard copies of that credit report that shows the debt is to be removed in October 2008, just in case they decide to re-age it and insert it back on your report.

    Lol That too funny... ok first and foremost... just because they cease and desist the debt it still doesn't go away... everyone thinks its quick fix for people who ignore their debt and it only puts a band aid over their debt problems!! If you don't want to deal with Asset LLc then you should have taken care of the debt with the original creditor right? But because people have debt with Asset Acc they come on here and post bulletins and trash the company because they actually owe the debt in the first place... They are FDCPA compliant and thye follow the laws whether people believe it or not! They are the Worlds larget debt purchaing co and they don't put things on the CBR if its not with federal law of statute of limitaions which is 7 yrs... But the state laws differ... So maybe .just maybe people should start paying their debts before they keep trashing the company!!
