    Got a letter of penalty from IRS even after returning the rebate check
    Hi all

    I recently got a letter from IRS stating the letter of penalty for using 300 dollars rebate check. Actually I filed the taxes wrongly at the first time for the year 2007. But when I got the rebate check I written an apology letter to IRS and sent the rebate check without using it within 10 days. Now they sent me a letter in reference to my mail stating that they haven't taken any action on me and said that they will contact me after 45 days again on this issue. They have given me another letter with vouchers in that . There are two vouchers in that, one for making an inquiry and other for payment. They asked me to send the inquiry voucher if I do not need to pay a ny amount and the payment voucher if I need to pay any amount. I got rebate check for 300 dollars but I immediately sent the check back and amended my returns. Now I did not understand what to do. Is there any problem to my visa status and any fine imposed on me. Please help me in resolving this issue.

    Are they billing you for fines and penalities or return of the $300 - what are they asking you to pay?

    Actually I paid back the rebate check that I got and attached the amendment forms and an apology letter and requested not to impose any penalty and fines. Now in the letter they said that thanks for your cooperation. We haven't taken any action on the issue and we will contact you again after 45 days. You don't need to do anything now. If you have an installment plan for the payment,pay the amount. IF You already paid the amount and cut the middle voucher on the other letter which is for inquiry and post it to t he IRS, PA.

    My feeling is that you are being charged a penalty and interest for the time you had the money, whether you cashed the check or returned to them. Appears there was also a problem of some sort with your tax return and so you owe them.

    I don't think the IRS is going to drop their request for penalty/interest/fines based on a letter of apology. They may think about it for a while, charging you interest the whole time.

    In order to stop the interest from running I would NOW send them the difference between what they are demanding and what you have sent.

    Thanks for the reply. But how can know the difference amount. I just got the rebate check for 300 dollars and then I send it immediately. They didn't mention any mount in the letter. How can I know how much I owe and one of my friend also sent the rebate check he got before me and didn't got any letter from the IRS. Why I only got the letter and he didn't. He actually returned the rebate check immeidately the next day he got the check to IRS. I returned the check after a week. Is there will be any problem on my visa status or will there be any problem to my social security. Clear my doubts and help me to solvce this issue.

    Fill out the inquiry part of the voucher and send it back. There is also a phone number and possibly a case number - in addition to your SS number - on the form you got from IRS. Call and ask what they want and why.

    I have no idea why you and your friend both filled out your taxes improperly, both returned the checks and only you have been contacted by the IRS - so far.

    This should be no problem with SS. I don't know about your visa. I'd be more concerned about the incorrect tax return which resulted in you receiving the $300 refund than anything else. What was your error, was it intentional, how serious was it?

    I know the IRS is always advertising in my area that people who submitted incorrect info on their 2007 return in order to get the Incentive will be prosecuted and fined.

    I trust you simply made an error.

    Rather than agonize over this, call IRS and ask them!

    You filed resident tax return and received stimulus rebate. Now you have returned the rebate check and filed amended tax return. It should be form 1040X and complete non-resident tax return. If any tax is due on non-resident return, pay it. If no tax is due, then relax.
    If IRS has an enquiry, do send the reply. You will not have any problem. I doubt that IRS will ask for interest on stimulus rebate check that you returned without cashing it. It should not have any implication on your visa status.

    I agree with MukatA.

    If you returned the check without cashing it, or cashed the check and wrote a personal check for $300 within ten days of receipt, no interest or penalty should be due.

    Be SURE to respond to any letter or notice from the IRS. Formally ask that they waive all penalties and interest on the stimulus rebate.
