Sarah runs a confectionery shop. After the summer season she decided to refurbish the shop in time for the Christmas period, which was a busy time. She approached several firms who undertook this type of work but ‘Andy’s Handymen’, which was run by Andrew Smith, gave the most competitive quotation, which she accepted. It was agreed that the shop would be closed for two weeks, and the work completed by 7 November.
The work began well but at the start of the second week Andrew phoned Sarah to say that he could not complete the job by the 7th because the cost of basic materials had gone up. Sarah replied that that was not her concern and that they had an agreement. Andrew emphasised that, without extra money, he might have to compromise the original plan or go over time. The next day Sarah received a note from the local council reminding her that the annual ‘ens Night’ was to be held on 8 November. This night was a regular event and well attended by people throughout the region, and past years had proved particularly profitable for Sarah. She thereupon phoned Andrew and said that he could have another £1000 if the refurbishment was finished by the 7th.
Andrew finished the work by the 7th. However, ens Night failed to produce the expected level of business for Sarah and she now wants to know whether she is liable to pay him the extra £1000. Advise her accordingly
