    Serious Financial Trouble! Frozen bank account
    I had a debt with a major credit card company. I lost my job last year and after 7 months, I finally got a new one. During the period where I didn't have a job, I couldn't pay any bills. So the credit card company sent that bill to a collection agency. So, I didn't pay the collection agency either. The collection agency sent that debt to a law office. I just got a letter in the mail from the law office that was a summons for court. Today I found out that the same law office froze my bank account! How can they sue me in court for the debt AND, at the same time, take money from me in my bank account? Is this legal? I live in NY state if that matters. What should I do about the frozen bank account? I get direct deposit at work. I just want this debt paid.

    There are companies that would cut your dept in half and have you pay back half the money you owed, that's called a proposal

    Hello Sarah

    First of all ,if you ignored the civil summons then the creditor got a default judgement from the court that is how they got to"freeze" your bank account. A credit card company can not freeze your account on their own,it has to go through the court. I do not know about the laws in NY but I can say if you owe it they will try to get it How old is the debt? The sols may come in to play.

    Well the debt from the credit card company is from last year. Everything I read says that they can't freeze your bank account unless you don't show up for court or until after they win a judgement against you. Doesn't make sense to me. I haven't had a court date or anything set in stone yet. I did, however, the other day, as soon as I got the letter, sent it to my debt consolidation company and they were able to work with the law office and come up with monthly payments of 100 dollars. But I still have to notify the court and the law office of this payment arrangement.

    If your bank account is "frozen" go to the bank and ask to see a copy of the paper work they have. That should have a number you can call Any way a bank account can only be frozen from a credit card company that has gotten a judgement against you

    Right, and the law office sent me the letter so therefore they HAVE a judgement against me.
