    Apartment trying to get $
    2 years ago my husband and I moved out of our apartment building we signed a notice to move out early and we paid a pro rated rate. We moved out and now they 2 1/2 years later they sent a letter saying we owe 200, we are trying to get into a house and this looks bad on us we do not owe this money the collections agency are being very rude I told them that I would only pay 100 cause I don't owe this $$ they said no call me when you can pay this and hung up on me. I called the apts and they said they have no record of me and my file was probably shredded. I don't want to pay this, this is not right. Our rent was 600 we paid 300 and they kept our 200 deposit and still they are seeking 200 what should I do?? HELP

    If this is a collection agency trying to collect, send them a DV letter. If they can not validate the debt, they can not collect on it.

    Pull your credit reports, you can get them for free, see if they are reporting on that. www.annualcreditreport.com

    Do you have copies of where you paid when you moved and everything.

    No I don't have any paperwork the rep working there at the time didn't nake a copy of the move out letter and that was stupid on my part for not asking. I kept a copy of the money order that I made to them but after 1 year and 2 moves later I got rid of it. What is a DV letter??

    DV means debt validation.

    If they have no proof that you owe the debt, then they can't legally collect it.

    Do as has been instructed and send a letter. State in the letter that you deny the debt, and you are requesting validation of this debt.

    Send it certified mail, return receipt requested so you have proof and keep a copy for your records as well.

    If they can prove the debt, and you terminated your lease early, you may have to pay it to make it go away.

    See what the request for validation gets you.

    Yes, if you challenge the credit report, if the apartment can not verify it will have to come off. Also as noted if the credit collection company can not verify the debt they can not collect. As noted challenge everything esp if you don't owe it.

    Well I asked the agency and they have my file however they don't have the ltr that my husband and I signed stating that we were moving out early. Yet they have everything else. I know its only 200 but it's the principal of the whole thing besides that's 200 for we don't have.
