I have lived at the same address in California for 12 years. However, I am originally from Oklahoma and have been spending almost have my time there due to family issues.
I receive royalty from Oklahoma which requires me to file Oklahoma tax returns as well as California.
I am entertaining the idea of applying for a nursing program in Oklahoma due to the long waiting lists in California. However, the college in OK wants to see tax returns from OK and I am questioning the law for living in these two states and being a resident in both states. Out of state tuition is more than double if I cannot prove residency in Oklahoma.

My stepdaughter thought she had established residence in two States - California and NY - specifically to go to school in California.

She was told she could be only a resident of one State at a time and denied because her primary income tax return (Federal) was filed with a NY address.

Since I do have income from OK and CA, what would prevent me from filing my Federal Income tax docs in OK for a couple of years? I do have addresses in both states.

I have my checks direct deposited into an online account which I could live anywhere and have. Should I change all addresses to OK, even my credit card statements? All those bills come via e:mail anyway. With so much moving toward the internet, I don't see what difference it would make which state I file my fed returns in. As I mentioned, I am working minimal hours in CA since 2008.

I would decide on which State is going to be the permanent residence (despite other income earned in another State, not all that uncommon) and make sure my Federal Returns are filed from the residence State - as well as insuring my car, getting my drivers license, having my bill sent there and VOTER REGISTRATION. I don't think anyone is going to argue if you are registered to vote in your "permanent" State.

You sort of have to "move" to one State and live there and then maybe go on vacation in the other - and your mail and various legal documents have to show that.

Each state willl have specific rules on being a resident, often based on where you actually reside ( live, get your mail , not merely get income) I get income from 4 states, 2 of which I have never lived that does not make me a resident for that state.

Where is your drivers license, where is your home, where is your car registered, and so on, But as noted each state will have its rules on being a resident
