My landlord is trying to create a new lease and I have only been there for 1 month! Before moving in, there was a lot of HER trash throughout house and outside as well as in basement. She promised to have all of it removed within days of moving in. the only reason I moved in before she got the trash out was because my lease was up in my apartment and I needed quickly move! It has now been 1 month and now that rent is due, I told her I would give her my money order when she gets this trash out! She wants to creat a new lease and now require a deposit that she WAIVED! What can I do about this?:mad:

If you already have a written lease then there is nothing that she can do until the lease term ends. However if I were you I would not withhold the rent. Instead I would send her a letter by certified mail with a copy by regular mail. In the letter you should tell her that she has failed to remove her trash as promised and if it is not removed within the next 5 days then you will arrange to have it cleaned out and you will deduct the cost from the rent.

If you don't have a written lease then you are a month-to-month tenant and she can create new terms, including an increase in the rent, with 30 days advance written notice.
