    Taking his RIGHTS
Our son calls and text's his dad and he never responds back. He doesn't show up when it's his weekend to pick him up. When can I take him to court to have his rights taken away so my son's step dad can adopt him?

When the dad agrees to sign his rights over to the step dad so he can adopt him

Yes, just not calling or seeing the child is not grounds to "take" any rights away, even if he does not pay his child support there is not normally grounds.

So you will have to get him to sign over his rights for step dad to adopt.
If the real father has been to prison, or is proven to be a serous threat to the child you can often get the rights taken away
