    Social Security Refund for Dual Status
    Hello ,

    I was on OPT status till SEPT40 2005 and from Oct1st2005 my status changed from OPT to H1. My company still withdrew my Social security and medicare taxes and asked me to get it back while failing for taxes. I am an Indian citizen and I guess I come under Dual Status and can file the 1040NR-EZ and claim a stadard deduction. What Form do I send to get a refund on the social security and medicare tax and also can I get a refund for the whole year or just till the Oct 1st. Please let me know . Appreciate Your Help.

    You are NOT dual status; you should file Form 1040NR-EZ as a non-resident alien. You will file as a resident alien in 2006.

    You file Form 843 to get the refund of Social Security and Medicare taxes withheld while you were under F-1 visa status. Download IRS Pub 519 and review pages 45 - 47 for the process.
