My husband and I are in the process of buying a house and need to give our landlords notice and want to know if anyone has a sample letter I can use. We have not signed a lease in several years and our lease (if we had one) would be up this month. We will be moving the 2nd week of September.

Also we would like to know what the normal wear and tear is. We have lived in the house for 5 years (we live in California) and we are wondering if carpet replacement and painting would be normal wear and tear. We have animals so there are a few stains from them on the carpet that will not come out.

Keep it simple:

This is to inform you that we will be moving out as of <insert date>. Can we schedule a walk through on <insert date>?

You might consider paying to have the carpets cleaned and show the landlord the recipt during the walk through.

Thanks. I was pretty sure we should get the carpets cleaned so we will probably do that so we can get most of our deposit back if not all of it. What about holes in the walls and stuff like that? We have a few big ones that we will for sure patch up but small ones are OK right?

It depends on the landlord. I would think they would have to spackle and paint any holes at your expense.

Yes, I as a landlord expected my tennants to do even the small nail holes, and the large ones to be done properly. The trouble with the covering the holes, it will leave places not painted.

Need a sample letter of non-renewal of lease

Dear Landlord,

This the our 30 day (or whatever is required by your "lease" and/or state LL / tenant law) notice that we will be vacating our rental unit at _____________address_________ effective September 23, 2008. We will be completely out by midnight that night.

We will contact you closer to that date to make arrangements for a walk-through and to return keys. Or please feel free to contact us.

But remember if you wanted to move out by mid Sep, you needed to have give the witten notice August 1 to cover from pay period to pay period. So at this point you can give a notice to move on end of 30th
